Below is a copy of our "Photo Shoot Agreement" which you will be required to sign before any shoot takes place.
We apologise for any inconvenience but, this agreement has been put in place to protect both parties.
This agreement may differ slightly from the one attached to your quote, please read that one carefully.
Please note that YOUR PHOTO SHOOT WILL NOT TAKE PLACE UNTIL BOTH PARTIES are in possession of A FULLY SIGNED COPY OF THIS AGREEMENT.
This agreement is between Ken Mann of Ace Photography (hereinafter “Photographer”) and “Full Name of Client” (hereinafter “Client”)
The type of photo shoot the Client has requested is a “Description of the Shoot”
The Clients photo shoot will take place on “Date the Shoot will take place” at “Venue/Location of Shoot and Town of Shoot”
The time of the photo shoot will be from “Start Time of Shoot” to “Finish Time of Shoot” which equals “Number of Hours of Shoot”
Quotation number for this shoot is “The Quotation Number of the Shoot”
The TOTAL PRICE for the contracted services is “Total Quoted Price of the Shoot”
The DISCOUNTED PRICE for the contracted services is “Total Discounted Price of the Shoot.
Discounted Price Terms and Conditions.
A deposit of 50% (Fifty percent) of the TOTAL PRICE stated above is due and payable at the time of signing this agreement.
This also confirms your booking. The remaining balance of the DISCOUNTED PRICE stated above must be paid in full no later than the date of the shoot, to receive your discount.
If the balance of the DISCOUNT PRICE, stated above, is not paid on or before the date of the shoot the balance of the TOTAL PRICE, stated above, will become due.
These retainers are non-refundable upon cancellation of the event, but may be re-applied for, subject to availability if the event is rescheduled. Any discounts on offered by Ace Photography are applied on the date that this quotation was prepared. (For example, The discount offered on our website on the 1st of January XXXX will be applied to a quote prepared in January XXXX. If the said shoot is scheduled to take place on the 12th March XXXX and the discount offered on the Ace Photography website in March XXXX is greater or less than the discount offered in January XXXX, the January discount offered will remain in force for this shoot.) Description of Services.
The parties agree that the photographer will furnish photographic coverage on the above date.
Photographic coverage will include the services of the photographer for the time and date stated above.
Not later than three weeks after the date of the shoot, the Photographer will deliver to the Client a set of digital proofs on a USB memory stick or via dropbox or other means arranged with the Client.
All edited photographs will be supplied in JPEG format at a screen display resolution (72ppi). (Please read and understand the "Post Production and Editing" paragraph below)
Overtime (Any time over and above the times stated above) will be charged at the rate stated on the quotation, fractions of an hour to be prorated in increments of quarter hours.
No overtime charges will be incurred without the prior written or verbal authorisation from the Client.
The Photographer will be the exclusive professional photographer retained by the Client for the purpose of this shoot. Post Production and Editing.
The post production and editing which is provided for in this shoot is as follows…
1. Transferring RAW files from camera memory cards to the computer.
2. Initial review of all images and deleting any images where quality is not up to standard.
3. Correcting for White Balance, Exposure, Contrast, Noise, Sharpness, Hue, Saturation, Vibrancy, Colour, Cropping images for better composition and resizing images. This is all done in "Lightroom CC."
4. All images are then converted to "PSD" images, rechecked, tweaked in "Photoshop CC" and also converted to black & white.
5. The final step is converting images to the standard "JPG" format and preparing the images for delivery to the Client.
6. ANY OTHER/FURTHER MODIFICATIONS "PHOTOSHOPPING" OF IMAGES WILL INCUR AN EXTRA CHARGE OF “Rand Value” PER HOUR AND ONLY AFTER A QUOTE FOR THIS MODIFICATION HAS BEEN PREPARED AND ACCEPTED BY THE CLIENT unless otherwise allowed for and stated in this quote. Product Pricing.
Pricing is defined on the Photographer’s quotation on page two of this document, supplied for this event.
Prices quoted for professional services, photographs, and albums are guaranteed for a period of three months following the date of the event stated above.
Extra services/orders placed after the signing of this contract which are not in the above stated quotation will be quoted for separately and billed accordingly, this includes further modifications of images. Limitation of Liability.
While every reasonable effort will be made to produce and deliver outstanding digital images of the photographic event, the Photographer’s entire liability to the Clients for any claim or loss arising from the Photographer’s performance is limited to a refund to the Clients of the amount paid for services and that no other compensation for direct or consequential losses to the Client can and will be entertained and the Client, through signature of this agreement, specifically waivers and renounces the protections related to direct and consequential losses contained in the Consumer Protection Act of the Republic of South Africa.
The photographer for the shoot will be Ken Mann himself. In the unlikely event of personal illness or other circumstances beyond the control of the Photographer, a substitute photographer, subject to acceptance by the Client prior to the event, may be sent to fulfil the obligations of the Photographer herein contracted. In such case that the Client declines the substitute photographer, the Client may instead terminate this agreement and receive a full refund of all monies paid. Copyrights & Usage.
The Photographer will only make reproductions for the Client or for the Photographer’s portfolio, web site, social media, samples, self-promotions or for professional competition and review. The Photographer will not make reproductions for any other use without first obtaining the written permission of the Client. Agreement.
This agreement incorporates the entire understanding of the parties, and the parties agree to all its terms, and acknowledge receipt of a completed copy of the agreement signed by all parties. Any modifications of this agreement must be in writing and signed by all parties. Each person signing as Client(s) below will be fully responsible for ensuring that full payment is made pursuant to the terms of this agreement. Once I have received a signed copy of this agreement from you I will check the agreement, sign, date and return a fully signed copy to you for your records. Please take note that NO photo shoot will take place until this agreement is signed by both the client and the photographer. |
